Brazilian National Health Regulatory Agency proposes new regulations for electronic cigarettes and initiates public consultation

According to Brazilian media Conselho on January 25th, the Brazilian National Health Supervision Agency (Anvisa) is currently soliciting public opinions on the new regulations on e-cigarettes, and the related consultation and public voting activities will end on February 9th, 2024.
Anvisa approved the Consultation Public Voting (CP) plan in December 2023, with the plan number 1.222/2023, which mainly involves regulations on electronic cigarette devices (DEFs). This will replace the regulations that have been in effect since 2009 and become a new resolution.
The key points of the draft include continuing to prohibit the production, import, sale, distribution, storage, and transportation of electronic cigarettes, including all types of electronic cigarettes, and explicitly prohibiting any form of public promotion of these products, whether aimed at consumers or not.
The Brazilian National Health Commission (CNS) believes that Anvisa's proposal is crucial in improving the health and well-being of the Brazilian people. They support the revision of current regulations and believe that this adjustment is consistent with the recommendations and scientific evidence of the World Health Organization (OMS) on the Framework Convention on Tobacco Control.
All those who are concerned about this matter have the opportunity to participate and provide feedback before February 9, 2024. Participants can provide simplified feedback, express support for the proposal, and provide detailed comments on each clause of the proposal through the dedicated spreadsheet provided on Anvisa's official website.
The goal of Anvisa's public consultation is to make more informed decisions regarding specific regulations. Its main goal is to collect critical and evidence-based evaluations of regulatory recommendations from various levels of society.
